How does tax work between Spain and Brazil?

Spain and Brazil have had a comprehensive double-taxation agreement in force since 1976 (Decreto nº 76.975/1976 on the Brazilian side). For most income types, you offset tax paid in one country against tax owed in the other on the same income.

On the Brazilian side, tax residency triggers at 183 days; after that, IRPF on worldwide income via monthly Carnê-Leão plus an annual DIRPF.

On the Spanish side, you are tax resident if you spend more than 183 days in Spain in a calendar year, or your centre of economic interests is there. Once you break Spanish residency, you are generally only taxed on Spanish-source income.

Modelo 720, Modelo 721, and the Spanish reporting gotchas

A few specifically Spanish things to know:

  • Modelo 720, until 2022 this was the heavy-handed foreign-assets reporting form, with disproportionate penalties. EU courts ruled the penalty regime illegal in 2022; the form still exists but penalties are now standard.
  • Modelo 721, newer reporting form specifically for crypto assets held abroad (over €50,000 threshold).
  • Exit tax, Spanish exit tax can apply to unrealised gains on large securities holdings (>€4M or >25% of a single company) when you cease tax residency. Most ordinary remote workers will not hit the threshold.
  • Plan de Pensiones, Spanish private pension contributions lose most of their tax benefits when you are non-resident.

How do you handle money between Spain and Brazil?
